By Streamlining Administration, Delegating Power to Lower Levels and Transforming Functions, What has China Customs Transformed?
[Netizen: Da Zhong Guo]: I am much more concerned to the Customs’ right of discretion. Is there any reform in this regard this time? 04/03/2014 10:17:20
[Chen Xudong]: Thanks for your concern about the Customs’ work. As to more regulation on the Customs’ right of discretion, it is one of the important supporting measures taken by the Customs to streamline administration, delegate more power to lower levels and transform government functions. First of all, we have found out the bottom line of the Customs’ right of discretion, clarified relevant principles and standards, and developed implementation schemes and management methods to standardize such discretion. Secondly, we are studying and developing the standard measures for discretion related to key enforcement areas, such as commodity classification, unit consumption management and administrative penalty. 04/03/2014 15:23:50
[Netizen: Lu Guo]: In my opinion, transparency is the most important. I hope that the Customs can be more transparent in terms of official affairs. Interviews like this works well, and everyone can raise their questions. 04/03/2014 10:18:14
[Chen Xudong]: The Customs have been trying to improve the transparency of their official affairs. Earlier this year, we amended the Administrative Measures of the Customs of the People’s Republic of China for Government Information Disclosure, which has been issued for enforcement. In the future, we will disclose the matters relating to vital interests of administrative counterpart to the public in a timely, accurate, comprehensive and specific manner, and actively accept social supervision, exercising the Customs’ authorities under the sun. 04/03/2014 15:24:35
[Netizen: Zhu Hai Wang You]: Good afternoon, Mr. Chen! I’d like to know what kind of exam will be adopted in 2014 after the qualification exam for customs declarers is cancelled. And when will there be any relevant notice? We foreign trade practitioners are eager to get relevant information and looking forward to your answer, thanks. 04/03/2014 14:32:19? [Chen Xudong]: Ms. Qiu has answered this question just now. The national uniform qualification exam for customs declarers will be cancelled from 2014 onwards. The Customs will no longer set any threshold in this regard, and the customs declarers will be selected and employed by customs brokers on their own. I noticed that many people raise the same question online. So please help us spread the answer to those who are concerned about this issue. 04/03/2014 15:26:01
[Netizen: anonymous]: May I ask to whom the power will be delegated? 04/03/2014 14:36:08
[Chen Xudong]: According to the principle of “Three Priorities” specified in the Administrative Licensing Law, the streamlining of administration, power delegation to lower levels and functional transformation of the Customs are designed to return the power to the market, concede the power to the society and delegate power to the lower-level authorities, making the market play a decisive role in resources allocation and better displaying the role of the Customs as government organs. 04/03/2014 15:27:17
[Netizen: anonymous]: I wonder when will the detailed rules and regulations concerning the Provisions on Registration of Customs Brokers (Declaring Enterprises), namely, the appendix to the GACC Decree [2014] No.211 be issued. 04/03/2014 14:40:34
[Chen Xudong]: The GACC will no longer develop detailed rules and regulations concerning Decree No.221, but the customs districts directly under the GACC may formulate their own internal operating rules according to the actual situations in their customs districts. Since I have no idea about the customs district where your company is located, I suggest you to directly contact the local Customs House. 04/03/2014 15:28:00
