When Can the Customs Make Inspection at Their Discretion?

In accordance with the Customs Law of the People's Republic of China, the Customs may directly inspect or re-inspect the imported/exported goods or pick up samples thereof whenever they deem necessary. The Customs may make inspection at their discretion in the absence of the consignee/consignor when:

1. the imported/exported goods may be illegal smuggled goods;

2. the goods are not declared in due time; and

3. the owner of the goods is unknown.

If the Customs decide to make inspection at their discretion, they shall notify the officer where the goods are stored or other witnesses to witness the inspection, and both parties shall sign on the inspection record upon the completion of the inspection.
